We are committed to comply with the UK’s Data Protection Law and the General Data Protection Regulation (GDPR). Under GDPR This Is Me Psychology Ltd is a ‘data processor’ and ‘data controller’ which means that we must comply with the requirements set out in the GDPR. The Information Commissioner’s office (ICO) oversees compliance with this regulation, and as required, This Is Me Psychology Ltd is registered with the ICO (reference ZB645787). By visiting our website, contacting us, providing your personal information and using our services you are agreeing to us using your personal information for the purposes outlined in Our Privacy Policy. Please note that if you provide us with personal information about another individual, such as a contact or parent of a child, it is your responsibility to ensure that that individual is aware of and accepts the terms of this Privacy Policy.

 

What information is collected

When we refer to personal data, we mean any information that can or has the potential to identify you as an individual. This may relate to information that you provided up on the website, through the initial contact form or via e-mail or phone contact from yourself or a third party.

  • Personal data such as basic contact information including name, gender, ethnic origin, address, email, contact number, next of kin contact details, family members;

  • Special categories of personal data such as health information, GP contact details, educational setting.

  • Notes from initial assessment and therapeutic sessions, letters, reports and outcome measures;

  • Third party information that is shared with us, such as from school staff or allied health professionals

  • Third party reports

  • Patient feedback information you provide

  • If you complete a web-based enquiry form, we collect the information you provide to us and your internet protocol address.

If you are referred by your health insurance provider or another referring agency, we will also collect personal data provided by that organisation such as referral information, health insurance policy number and authorisation for psychological treatment. 

 

We also process data relating to our legitimate interests in running a business such as:

  • Invoices and receipts

  • Accounts and tax returns

  • Information to help with marketing (such as how you heard about our service).

 

Uses made of your personal information

We use your data for the purpose of providing Psychology services to you and for processing payment for these services.

 

Your personal data will be kept confidential and secure and will only be used for the purpose(s) for which it was collected and in accordance with this Privacy Policy, applicable Data Protection Laws, GDPR, clinical records retention periods and clinical confidentiality guidelines. Sensitive personal data related to your health will only be disclosed to those involved with your treatment or care, or in accordance with UK laws and guidelines of professional bodies or for the purpose of clinical audits (unless you object). Clinical audits can be used to review the service provision and ensure that This Is Me Psychology Ltd. continues to deliver effective high quality care to all service users.  
 

Security and storage of your personal information

The security of your Personal Information is important to us, and we will endeavour to ensure that this is protected against unauthorised or unlawful processing. However, please remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

  • All information recorded on paper will be securely stored in a locked filing cabinet;

  • Confidential digital information will be stored in a secure cloud service offering high levels of security;

  • Confidential information sent by the psychologist via the internet will be encrypted and password protected, with this sent separately by text;

  • Letters sent to professionals such as GPs, by surface mail, will be clearly marked Confidential;

  • All electronic devices  (e.g. computer, laptop and phone) used to access stored information will themselves be password protected.

 

Retention periods for that personal data

Personal information will only be stored for as long as it is required. At the time of writing this policy, in accordance with the Records Management Code of Practice (2023) any personal and sensitive data held by This is Me Psychology Ltd Service will be kept for eight years following its collection, and then securely disposed of*. Where relating to children, information will be kept by This is Me Psychology Ltd Service for until the child’s 25th birthday or 26th if they were 17 when treatment ended*.

 

*This is provided that no exemptions are in place at the time of disposal.

Who data is shared with

We take the protection of your data seriously and hold information about each of our clients and the therapy they receive in confidence. This means that we will not normally share your personal information with anyone else without your consent. However, there are exceptions to this when there may be need for liaison with other parties:

  • Relevant authorities when the information concerns risk to yourself or others. We will discuss such a proposed disclosure with you unless we believe that to do so could increase the level of risk to you or someone else.

  • Health insurance providers for the purposes of billing and to provide treatment updates where necessary; 

  • Those who have instructed us to provide psychological treatment, such as a solicitor.

  • In these cases, relevant clinical information from clinical session notes will be shared with legal services as required and with your consent.   

  • Law enforcement and regulatory agencies in connection with any investigation to help prevent unlawful activity or as otherwise required by law.

  • HMRC and other authorities as they require. 

  • With others pursuant to a court order. 

  • We may also request to share information with other parties, to whom we think that this information would be beneficial to your support, such as your GP or school. However, we will only share this information if you have given us consent to do so.

 

Please note that therapy sessions are confidential. Young people aged 16 and over are able to consent to the sharing/not sharing of their information (except in cases where there is risk of harm to themselves or others). For instance, we may think it is beneficial to a young person to share information with a parent/caregiver, but they may decline this consent, and we would adhere to this unless we were seriously concerned about safety or we thought that the child did not have capacity to make this decision. Young people aged under 16 are also often able to provide/withhold consent, where they are deemed to be competent to make this decision to share information, however we would generally also seek the consent of parents/caregivers.

As part of good practice, all Psychologists also access professional supervision with another qualified professional. Not all cases/patients would be discussed with a supervisor, though if you/your child was discussed, full names would not be used and the supervisor would also be compliant with GDPR. Only ‘need to know’ information would be shared, for the purposes of advice and consultation and to ensure you are receiving optimal treatment.

If we refer you for additional treatment, we will share with the person or organisation that we refer you to, the clinical and administrative information we consider necessary for that referral. We will always discuss this with you first in order to gain your consent. Please note that once you or your child have been referred on to the care of another clinician or service, our Privacy Policy will not cover their service and data collection provided and so we encourage you to verify their own Privacy Policies and compliance with UK and EU data protection laws.

Accessing Your Personal Data

Under the General Data Protection Regulation (GDPR) you have the right to access your personal data and supplementary information. You can make a 'subject access request' by emailing us at: contact@thisismepsychology.co.uk. Please note there may be exceptions to accessing certain information, for instance, in order to protect the rights of others.

Following this request we will:

  • Verify your identity to ensure you can have access to the data. A third party can make a request on behalf of an individual.

  • Review the personal information and supplementary data.

  • If approved we will send copies of the information by preferred secure means (ie electronically/recorded delivery).

  • We will respond to a request within one calendar month.

You also have the right to ask us to correct any personal information that we hold about you, which you think is factually incorrect. However, please note that this does not extend to matters of professional opinion such as clinical diagnoses.
